Diminished value claim in California

Diminished value is the drop in a car’s market value after it has been repaired. Here is how California measures it and what to gather.

Short answer

A diminished value claim asks for the loss in a vehicle’s value after repairs, on top of the repair cost. California’s civil jury instructions say that when a car can be repaired but is worth less afterward, the damages are the difference between its value just before the harm and just after the repairs, plus the reasonable cost of repairs, capped at the car’s value just before the harm. When another driver is at fault, you raise it with that driver’s insurer as part of the property damage claim. CACI No. 3903J

1. What diminished value means

California’s civil jury instruction on damage to personal property, such as a car, sets the general rule: the owner recovers the reduction in the car’s value or the reasonable cost of repairing it, whichever is less. The same instruction covers the case where the car can be repaired but will be worth less after the repairs. Then the damages are the drop in value measured immediately before the harm and immediately after the repairs, plus the reasonable repair cost. The total cannot exceed the car’s value immediately before the harm. CACI No. 3903J

The instruction defines fair market value as the highest price a willing buyer would have paid a willing seller, with no pressure on either and both knowing the relevant facts about the car’s condition and quality. CACI No. 3903J

2. When to raise it with the at-fault driver’s insurer

If another driver caused the crash, your property damage claim goes to that driver’s liability insurer. Loss of value after repairs is one of the items you can ask it to consider, alongside the repair cost. Whether and how much it pays depends on fault, the evidence and the policy limits. LegalMax does not predict that result.

If that insurer disputes liability or damages, California’s claim regulations require it to do so in writing. 10 CCR § 2695.7(b)(1) It also generally has 15 calendar days to respond to a message that reasonably calls for a reply. 10 CCR § 2695.5(b)

3. Under your own policy, the policy controls

A claim under your own collision coverage is a contract claim, so your policy’s wording matters. The notes to the same jury instruction say an insurer may write its policy to limit recovery to either the cost of repair or the loss in value, but not both. CACI No. 3903J, Directions for Use Ask your insurer which section of your policy applies, and ask for the answer in writing.

4. What to gather

  • Records of the car before the crash: photos, mileage, the window sticker or build sheet, and maintenance receipts.
  • The final repair invoice and parts list, including any frame or structural work and every supplement.
  • Photos of the car after the repairs are finished.
  • The other driver’s insurer, claim number and adjuster contact, plus the police report number if there is one.
  • Every letter or message in which the insurer explains what it will or will not pay.

Send copies, not originals, and keep a dated log of what you sent and when.

5. Questions to send the adjuster in writing

  • Will you consider loss of value after repairs as part of this property damage claim?
  • What information do you need from me to review it?
  • If you dispute it, will you explain the reasons in writing?

6. Keep it separate from total loss, rental and injury

Loss of value after repairs applies to a car that is repaired. If the insurer treats the car as a total loss, see what to gather and ask about a total-loss offer. Track rental costs and any injury paperwork in their own files; the property damage claim checklist shows how.

7. Where to ask if a question stays open

Common questions

Can I ask for diminished value if the crash was my fault?

That would be a claim under your own policy, so the policy wording controls. Ask your insurer in writing which section applies.

Is diminished value the same as the repair cost?

No. The repair cost pays to fix the car. Diminished value is the drop in the car’s market value that remains after the repairs are done.

Does LegalMax decide how much my car lost in value?

No. LegalMax helps organize your records and questions for the insurer. It does not set a value, and it is not a law firm.
